1. About pybanger

pybanger is a sole proprietorship based in Kerala, India. We provide Forex VPS (Virtual Private Server), MT5 Bot Development, and Custom Software services.

2. Reseller Disclosure

pybanger is a reseller of VPS infrastructure. The physical servers are provided by our upstream partners. We do not own the data center infrastructure. We pass through their service levels to you.

3. Service Delivery

VPS services are typically delivered within 1 hour of order confirmation and payment. In case of technical issues with our upstream provider, delivery may take longer.

4. Acceptable Use

You agree NOT to use our services for:

• Illegal activities of any kind
• Spam or bulk unsolicited email
• Hacking, port scanning, or network attacks
• Cryptocurrency mining (without written permission)
• Hosting or distributing malware
• Any activity that violates Indian or international law

5. Payment Terms

Payment is required in advance. We accept UPI payments only. All prices are in INR (₹) and are billed monthly. Payment is charged at the start of each billing cycle. You may cancel anytime before renewal.

6. Liability & Uptime

pybanger is not liable for any trading losses, missed trades, or financial damages caused by service interruptions. Our maximum liability is limited to the amount you paid for the affected month.

pybanger does not provide any express or implied uptime guarantee. Service availability depends on our upstream infrastructure provider. No SLA, credit, or compensation is offered for downtime unless explicitly stated in writing.

7. Governing Law

These terms are governed by the laws of India. Any disputes will be subject to the jurisdiction of courts in Kerala, India.

8. Forex & Regulatory Disclaimer

pybanger provides VPS infrastructure only. We do not provide trading advice, trading bots, investment services, or profit guarantees. Customers are solely responsible for ensuring their trading activity, broker, and jurisdiction comply with all applicable laws, including RBI, SEBI, and FEMA regulations. pybanger reserves the right to terminate service without refund if a customer's activity is found to violate Indian or international law.

9. Cancellation Policy

You may cancel your VPS at any time by contacting us via WhatsApp or email. Cancellation takes effect at the end of your current billing cycle. No partial refunds are issued for unused days. We recommend cancelling at least 24 hours before renewal to avoid auto-charge.

10. Abuse & Reporting

If you suspect abuse of our services (spam, attacks, illegal activity), report it to pybanger@gmail.com. We investigate all reports and may suspend or terminate accounts found in violation of our Acceptable Use policy.

Privacy Policy

1. What We Collect

When you place an order or contact us, we may collect:

• Your name
• Email address
• Phone number / WhatsApp number
• Payment information (processed securely by UPI — we don't store card details)
• VPS usage details (server IP, login times)

2. How We Use Your Data

We use your information to:

• Deliver and manage your VPS service
• Provide customer support
• Process payments
• Send service-related notifications

3. Who We Share With

We share data only with:

• Payment processors (UPI providers)
• Our upstream VPS providers (to set up your server)

We never sell your data to third parties.

4. Data Retention & Storage Location

We keep your data as long as you're a customer. After cancellation, we retain data for 90 days for legal purposes, then delete it.

Our VPS infrastructure is hosted in multiple locations including Bulgaria, London, USA, Canada, Singapore, and Hong Kong. Customer data may be processed in these jurisdictions. Our business operations are based in Kerala, India.

5. Your Rights

You can request:

• Access to your personal data
• Correction of inaccurate data
• Deletion of your data (after service ends)

6. Cookies

Our website currently does not use tracking cookies or analytics. If this changes, this policy will be updated.

Refund Policy

1. Refund Eligibility

You may request a refund under the following conditions:

• Full refund: If your VPS is NOT delivered within 24 hours of confirmed payment.
• Partial credit: If your VPS is continuously down for more than 24 hours (subject to our upstream provider's SLA).
• No refund: Once your VPS is delivered and running normally. Server resources are allocated to you, so we cannot offer refunds after this point.

2. Non-Refundable Situations

Refunds are NOT available for:

• VPS that has already been delivered and used
• Issues caused by the customer (misconfiguration, wrong terminal setup)
• Broker-side issues unrelated to VPS performance
• Customer's own trading losses
• Custom software development already started or delivered

3. How to Request a Refund

Include your order details, payment reference, and reason for the refund.

4. Processing Time

Approved refunds are processed within 7–10 business days. Refunds are issued via the original payment method.

5. Chargebacks

Please contact us before initiating a chargeback. We resolve most issues quickly and fairly. Unwarranted chargebacks may result in permanent account closure.
